Scientific Evidence Under the Daubert Standard

JSI President Judge Peggy Hora (Ret.) and JSI CFO Judge Brian MacKenzie (Ret.) will discuss making good rulings about scientific evidence under the Daubert standard and evidentiary and admissibility issues for  electronic and digital evidence at the 2019 Spring South Dakota Judicial Conference.

As a result of this program the attendees will be able to:

 1.  Recognize factors of admissibility of scientific evidence under a Daubert standard;

2.  Apply South Dakota’s Rules of Evidence regarding the admission Scientific evidence.

3.  Discuss cutting edge evidentiary issues surrounding authentication/foundation/hearsay rulings for social media, text messages, and other electronic/digital and digital evidence and,

4.  Apply those evidentiary standards to make correct rulings regarding electronic and electronic/digital evidence.
